Consumer Alert Center

Your weekly briefing on product recalls, FDA and CPSC safety alerts, new lawsuit filings, and federal enforcement actions affecting consumers across the United States. Updated every week.

Welcome to the Consumer Alert Center

Each week, the attorneys behind National Case Alert monitor federal agencies, court filings, and regulatory databases to bring you a curated summary of product recalls, safety alerts, and consumer litigation developments that matter.

This is not a comprehensive listing of every recall or lawsuit filed in the United States — hundreds occur every week. Instead, we focus on the matters most likely to affect everyday consumers: significant product safety recalls involving injury or death, major new class action and mass tort filings, notable government enforcement actions, and developments in ongoing litigation that our clients and prospective clients ask us about most.

If you see something here that affects you or someone you know, use the links within each entry to access the official agency source — and if you believe you may have a legal claim, we’re here to help.

California’s Attorney General filed an amended complaint in the nationwide PFAS “forever chemicals” litigation, accusing DuPont, Corteva, Chemours, and DuPont’s newest spinoff Qnity Electronics of shifting billions of dollars in assets and insurance rights between corporate entities to dodge responsibility for PFAS contamination cleanup and harm. The filing alleges these corporate restructurings amount to fraudulent transfers designed to keep money out of reach of states seeking accountability for water and environmental contamination linked to PFAS chemicals used in consumer and industrial products. The case is part of a large multidistrict litigation over PFAS-related environmental and health harms. Californians whose drinking water or property has been affected by PFAS contamination could benefit if the state succeeds in holding these companies financially responsible.

FTC Sues Hims & Hers Over Sharing Sensitive Health Data and Deceptive Billing

Court: U.S. District Court, Northern District of California (Case No. 3:26-cv-07871) Action By: FTC, joined by Utah and California

The Federal Trade Commission, joined by Utah and California, sued telehealth company Hims & Hers, alleging it shared customers’ sensitive medical information — including details about the conditions they sought treatment for — with advertising platforms run by Meta, Snap, and other tech companies, despite marketing its service as private and discreet. The complaint also alleges the company made it hard for customers to tell when they would be charged for a prescription and made it difficult to cancel a subscription once signed up. Anyone who has used Hims & Hers telehealth services could be among those whose information was allegedly shared. The case is newly filed and ongoing; consumers do not need to take any action at this stage, and the company has said it will contest the allegations in court.

As part of the resolution, OSF agreed to pay $552,250 and follow a two-year corrective action plan to strengthen its security practices. Anyone who received a notification letter about this incident should watch bank and insurance statements for unfamiliar activity and consider a credit freeze or fraud alert as a precaution.

CA AG Settles With Sweetwater Care Nursing Home Chain Over Understaffing

Action By: CA AG

California’s Attorney General secured a $15 million settlement with Sweetwater Care, a chain of 17 skilled nursing facilities, after an investigation found the company was paid tens of millions of dollars by the state’s Medi-Cal program while its homes were staffed below California’s legally required minimum levels in more than 14,000 instances between 2021 and 2024. The settlement requires $12.5 million in penalties and costs plus $2.5 million toward improving staffing, and puts an independent monitor in place at all 17 facilities for three years. This affects patients and families with loved ones in Sweetwater-operated nursing homes, particularly elderly and Medi-Cal-dependent residents who rely on adequate staffing for basic care. No action is required from residents or families; the monitoring and corrective measures are handled through the settlement itself.

Johnson & Johnson Proposes $5.5 Billion Settlement Over Talc Ovarian Cancer Claims

Court: U.S. District Court, District of New Jersey (MDL No. 2738) Action By: Private Plaintiffs

Johnson & Johnson has proposed a $5.5 billion settlement to resolve nearly all of the roughly 76,000 remaining lawsuits claiming its talc-based baby powder caused ovarian cancer, following more than a decade of litigation. The deal covers cases consolidated in federal court in New Jersey as well as related state-court cases, and is conditioned on at least 95% of remaining claimants agreeing to participate. Under the proposed terms, the company would make an initial payment of up to $3 billion next year, with further payments due starting in 2028. This affects people who used the company’s talc-based powder products and were diagnosed with ovarian cancer, or their families; the company continues to deny that its talc products caused cancer and stopped selling talc-based baby powder in the U.S. and Canada in 2020. People with pending claims should watch for official notices about the settlement process; the deal was not yet finalized as of this report.

FTC Settles With Elite Events Over Illegal Ticket-Buying Scheme

Court: U.S. District Court, Southern District of Georgia, Augusta Division Action By: FTC

The FTC reached a settlement with Georgia-based ticket broker Elite Events (doing business as Smart Scalpers) and its two owners, resolving allegations that the firm illegally got around ticket-purchase limits to buy up millions of dollars’ worth of tickets to high-demand concerts and events, in violation of federal law. This matters for concertgoers and event fans who compete against automated, high-volume buyers when tickets go on sale, often driving up resale prices. The settlement imposes $10.7 million in civil penalties, though most of that will be suspended once $300,000 is paid, reflecting the defendants’ stated inability to pay the full amount; the full penalty becomes due immediately if they are found to have misrepresented their finances. No action is needed from consumers; this was a government enforcement resolution, not a claims process.

New York Sues 3M, DuPont, and Other Chemical Makers Over “Forever Chemicals” Contamination

FTC and Five States Settle With John Deere Over Farmers’ Right to Repair

Action By: FTC, Illinois, Arizona, Michigan, Minnesota, and Wisconsin

The Federal Trade Commission and five states reached a settlement with farm-equipment maker John Deere requiring it to give farmers and independent repair shops the same diagnostic tools, software, and manuals it gives its own authorized dealers. Regulators had alleged Deere illegally blocked farmers from fixing their own tractors and equipment, forcing costly trips to dealerships for repairs. Under the settlement, Deere must provide this access for the next ten years under government oversight. Farmers and independent repair businesses should now be able to obtain diagnostic and repair resources directly from Deere.

Action By: 46-state coalition led by California and New York Attorneys General

A coalition of 46 state attorneys general, including California and New York, secured a $45 million settlement from Block, the company behind the Cash App payment platform, over claims it misled users about how safe their money was and failed to protect them from fraud. Investigators found that Cash App went years without a working customer service phone line, leaving locked-out users vulnerable to scam call centers posing as support, and that the company knew fraud was rising on the platform but was slow to respond. Cash App must now provide real customer service and stop misleading marketing about account safety. A related federal settlement may also provide separate direct payments to affected consumers — anyone who had money stolen or mishandled on Cash App should watch for official notices about eligibility.

Honda Faces Class Action Over Front Camera Defect Disabling Multiple Safety Systems

Court: U.S. District Court, Central District of California Case No.: 2:26-cv-06222 Action By: Private Plaintiffs

A proposed class action was filed against American Honda Motor Co. alleging that certain 2018–2025 model year Odyssey, HR-V, Clarity, Civic, and Pilot vehicles have a defective front camera sensor that can cause several driver-assistance safety features to fail at once. The lawsuit claims Honda knew about the defect but continued marketing the vehicles as equipped with reliable safety technology. The case seeks to represent all U.S. purchasers and lessees of the affected models and remains in early-stage litigation, with no rulings or settlement reached yet. HHS Settles HIPAA Ransomware Case Against Spencer Gifts Health Plan for $450,000 — 10,023 Employees’ Health Records Exposed

Agency: HHS Office for Civil Rights Action By: HHS OCR Individuals Affected: 10,023

The U.S. Department of Health and Human Services’ Office for Civil Rights announced a $450,000 settlement with the employer-sponsored health plan of Spencer Gifts LLC — the national retail novelty chain — following a 2021 ransomware attack that exposed the protected health information of more than 10,000 health plan members. A cyberattacker accessed the company’s network for two days in November 2021, encrypting files and potentially viewing or stealing plan members’ names, home addresses, phone numbers, email addresses, dates of birth, and Social Security numbers. Federal investigators found that Spencer Gifts’ health plan had failed to conduct an adequate security risk analysis before the attack — a basic requirement under federal health privacy law. As part of the settlement, the plan must complete a two-year corrective action program overseen by federal regulators, including updated security policies and mandatory workforce training. This marks HHS OCR’s 20th enforcement action involving a ransomware breach and its 14th action focused on inadequate security risk analysis.

CooCooBaby “Classic” and “Deluxe” Baby Loungers Recalled for Suffocation and Entrapment Hazards — Violate Federal Infant Sleep Standards

Agency: CPSC Units: ~2,355 Injuries Reported: None reported Sold At: CooCooBabyOfficial.com, Amazon.com Dates Sold: December 2024 – March 2026

The Consumer Product Safety Commission has recalled approximately 2,355 CooCooBaby “Classic” and “Deluxe” Baby Loungers because they fail to meet federal safety standards for infant sleep products, posing a serious risk of suffocation and falls. The sides of the lounger are shorter than the required minimum height; the sleeping pad exceeds the maximum permitted thickness, which can press an infant’s face into the fabric; and an opening at the foot of the lounger creates a risk of entrapment or falling. These loungers were sold on CooCooBabyOfficial.com and Amazon.com between December 2024 and March 2026 for $35 to $70. Parents should stop placing infants in these loungers immediately, cut the product in half to prevent further use, and contact CooCooBaby at support@coocoobabyofficial.com for a full refund.

FTC Sues Genesis Tech Enterprise and Halts $250M Subscription Scam Operation — Apps Include Nebula, MadMuscles, Wisey, Harna, and PDF Guru

Court: U.S. District Court, N.D. California Action By: FTC

The Federal Trade Commission filed a lawsuit and obtained a court order temporarily halting a network of 15 companies and 8 individuals accused of running a large-scale subscription billing fraud through popular smartphone apps, including Nebula (horoscope and psychic readings), MadMuscles and Harna (fitness), Wisey (an ADHD and productivity course), Unimeal (nutrition planning), and PDF Guru (document editing). The FTC alleges that the enterprise — organized under the Genesis Tech umbrella and operating from Cyprus and Delaware shell entities — used deceptive free-trial offers, buried disclosures, and unauthorized recurring charges to deceive consumers, while making it deliberately difficult to cancel subscriptions. From early 2023 through mid-2025, just five product lines from the scheme generated nearly $250 million in global revenue, according to the complaint. If you believe you were charged without consent by any of these apps or services, you may be entitled to a refund; check the FTC’s refund page at ftc.gov/enforcement/refunds for updates as the case proceeds.

CPSC Fines Daikin $8.5 Million for Concealing Fire Hazard in Hotel-Style Air Conditioners for Years

Agency: CPSC Action By: CPSC

The Consumer Product Safety Commission announced that Daikin Comfort Technologies Manufacturing, Inc. has agreed to pay an $8.5 million civil penalty after the company knowingly failed for years to report a fire defect in its packaged terminal air conditioners and heat pumps (PTACs) — the large, wall-mounted heating and cooling units found in hotel rooms, assisted living facilities, and multi-family apartment buildings across the country. Between 2017 and 2023, Daikin received more than a dozen reports of fires and one report of a smoke inhalation injury linked to the overheating of a component called the “DigiAir” module, but the company did not notify federal safety regulators as required by law. This delayed reporting kept potentially dangerous units in service in occupied spaces for years without consumer warning. In addition to the $8.5 million penalty, Daikin must appoint an internal compliance monitor and provide the CPSC with annual reports on its compliance program. Hotel guests, residents, and facility managers who are concerned about these units should contact Daikin at 1-844-DAIKIN1 or visit the CPSC recall database for more information.

California Attorney General Rob Bonta announced a $4.6 million settlement with Select Portfolio Servicing (SPS), one of the nation’s largest sub-prime mortgage servicers, resolving claims that the company violated state and federal mortgage servicing laws during the COVID-19 pandemic. Under the settlement, subject to court approval, SPS must pay $1.6 million in civil penalties to California and $3 million in direct relief to affected borrowers in the state. SPS must also reform its practices going forward to ensure homeowners get accurate, timely assistance when seeking foreclosure prevention. California homeowners who were serviced by SPS during the pandemic period and experienced problems getting mortgage assistance should review the Attorney General’s press release for details on potential consumer relief.

Recall #: NHTSA 26V320 Agency: NHTSA Units: ~43,566 Injuries Reported: None reported

Toyota is recalling approximately 43,566 model year 2024 Tundra pickup trucks equipped with the V35A engine because manufacturing debris may have contaminated the engine during production, potentially causing a main bearing to fail. Corewell Health Faces Federal Class Action Over Alleged “Balance Billing” Scheme — Patients Charged for Debts Already Paid by Insurance

Court: U.S. District Court, Eastern District of Michigan (Detroit) Action By: Private Plaintiffs

A new federal class action lawsuit was filed against Corewell Health, one of Michigan’s largest hospital systems with 21 facilities statewide, and debt collection agency DCM Services, LLC. The complaint alleges that Corewell Health engaged in a systematic practice of “balance billing” — sending patients to collections for medical debts that had already been paid in full by their insurance company, Medicare, or Medicaid, under the negotiated rates both parties agreed to. The lead case involves the estate of a Michigan man who died after emergency care at Corewell Health Butterworth Hospital; despite Blue Cross Blue Shield having settled his bill, the estate allegedly received a collection demand for more than $42,000 in charges the insurer had already covered. The lawsuit asserts violations of federal and state debt collection laws and seeks class-wide relief on behalf of patients across Corewell Health’s 19 hospitals named in the complaint.

The USDA Food Safety and Inspection Service issued a public health alert on May 24, 2026, warning that beef kofta served at The Kebab Shop restaurant locations may be contaminated with Shiga toxin-producing E. coli O157:H7. Nine people in California — including six children — have been confirmed ill, with five hospitalizations and two cases of hemolytic uremic syndrome (HUS), a dangerous kidney complication. The beef kofta was produced by Olympia Food Industries, Inc. Cox Media Group Settles FTC Charges Over Deceptive “Active Listening” AI Marketing — $930,000 Combined Penalty

Action By: FTC Defendants: CMG Media Corporation (Cox Media Group); MindSift LLC; 1010 Digital Works LLC Settlement Amount: $930,000 combined

The Federal Trade Commission announced on May 21, 2026, that Cox Media Group and two smaller marketing companies agreed to pay a combined $930,000 to resolve allegations that they misled clients about an AI-powered advertising service they called “active listening.” The companies falsely claimed their technology could target ads based on private conversations picked up by consumers’ smartphones and smart home devices, and also misrepresented that consumers had consented to this surveillance — neither claim was true. The FTC found the product did not work as advertised, and that consumers were never given the opportunity to opt in. Consumers who may have seen targeted ads and wondered whether their devices were being listened to without consent should know that the FTC found this claimed capability to be deceptive, and this type of advertising practice is now the subject of federal enforcement action.

25 State Attorneys General Sue to Block Federal Rule Slashing Student Loans for Nursing, Physical Therapy, and Other Health Care Students

Action By: NY AG (coalition of 25 states + D.C.) Court: Federal district court

New York Attorney General Letitia James led a coalition of 25 state attorneys general and the District of Columbia in filing a federal lawsuit on May 19, 2026, to block a new Trump administration rule that sharply limits federal student loan amounts for students enrolled in nursing, physical therapy, occupational therapy, social work, speech-language pathology, and other health care training programs. Under the challenged rule, students in these fields would be capped at $20,500 per year in federal loans — far below typical program costs — forcing many to take on expensive private debt, delay graduation, or abandon their studies entirely. The coalition argues the rule was issued unlawfully and will worsen the country’s existing shortage of health care workers. Students currently enrolled in or planning to apply to affected health care programs should monitor this litigation, as a court order blocking the rule could preserve their current loan eligibility.

NYC Health + Hospitals — the largest public hospital system in the United States and a primary provider of care for uninsured and Medicaid-eligible New Yorkers — disclosed in May 2026 that a third-party vendor breach allowed hackers to access its systems from approximately November 25, 2025, through February 2, 2026. The stolen data is among the most sensitive possible: it includes not only names, addresses, Social Security numbers, and government-issued ID documents, but also full medical records (diagnoses, medications, test results, imaging), health insurance details, billing and payment information, and biometric data including fingerprints and palm prints collected at facilities. The system reported the breach to federal regulators, identifying at least 1.8 million affected individuals.
